His influence on several authors (such as Augustinus, Isidorus Hispalensis, Rabanus Maurus, Petrus Venerabilis) and, above all, on the mediaeval treaties De amicitia written by Aelredus Rievallensis and Petrus Blessensis.

Este artículo explora desde una perspectiva filosófica la forma como la rostricidad está asociada al deseo y producción de subjetividad. De ahí que el campo de interés se centre en cómo dichas categorías tensionan la constitución subjetiva de los sujetos, a tal punto que inciden en la proyección de su propio trayecto biográfico. Esto a partir de algunos planteamientos teóricos acuñados por filósofos como Foucault, Deleuze y Guattari, con respecto al papel del rostro como productor de significado cultural en la (...) gestión de la economía del deseo. Noticia de un secuestro (1996), del Premio Nobel de Literatura Gabriel García Márquez, representa a la sociedad colombiana que atraviesa por un período caracterizado por el desarrollo de actos narcoterroristas, del cual se detecta el funcionamiento de Pablo Escobar —jefe del Cartel de Medellín— hacia el Gobierno. El presente artículo tiene como finalidad hallar aquellos referentes que permiten ubicar esta obra literaria en lo histórico y lo social —definidos desde la percepción del criminólogo Luis Rodríguez Manzanera al precisar (...) sobre la forma delictiva y la tensión provocada en la ciudadanía para denominarlas como macrocriminalidad—, junto con lo político-filosófico (el capitalismo definido desde el marxismo-leninismo) y lo literario —considerando el posboom como una manifestación artística que permite la incorporación de elementos propios de los Estudios Culturales; como, por ejemplo, la articulación de lo nacional y la crítica ideológica al sistema que los impera. Esta investigación retoma la obra de Gabriel García Márquez, Noticia de un secuestro (1996), con la volición de cuestionar la idea de Estado nación que está inmersa en el libro. Para ello, es necesario entender que la naturaleza del texto exige un conocimiento amplio al lector o al intérprete, puesto que su contenido revela datos multidisciplinarios. Además, es insoslayable realizar un análisis discursivo de la historia de ese contexto y cotejar con pasajes del mismo libro. Para facilitar esta labor, (...) la extrapolación de conceptos del teórico Luis Rodríguez Manzanera será de utilidad, ya que él despliega definiciones de Criminología, un tema frecuente en la obra. Verbigracia, la macrocriminalidad, una noción que él postula, permite que se comprenda la complexión del periodo histórico finisecular del siglo XX en Colombia, etapa que le corresponde a Noticia de un secuestro. Por otro lado, es menester dilucidar que este estudio no se reduce a lo literario, lo histórico y lo criminológico, sino que abarca distintas disciplinas, por lo que la exigencia en la consolidación epistemológica e interpretativa estará demostrada consuetudinariamente, sin obviar la inmanencia de la obra. Este tipo de análisis interdisciplinarios ya ha sido trabajado desde los Estudios Culturales, tal como se constata en las investigaciones de Richard Johnson (2000) o Néstor García Canclini (1997). De igual modo, el intento de establecer lineamientos y conexiones entre disciplinas como las de Literatura y Derecho ya ha sido desarrollado por Stanley Fish (1986), Faustino Martínez (2005), Carlos Pérez (2006) y Denise Schalet (2014). A diferencia de estos abordajes ya estudiados, el objetivo de esta investigación es detectar y fundamentar cómo se articula una propuesta ideológica desde una configuración que reanuda elementos históricos y literarios. En específico, lo que se busca es argumentar por qué fracasó implícitamente un proyecto sociopolítico de democracia y progreso, a partir de un panorama de violencia, narcoterrorismo, corrupción, negociaciones ilícitas, transgresión a los derechos humanos e inseguridad ciudadana. Con todo ello, esta tesis de maestría terminará siendo fructuosa para análisis postremos de discursos que tienen como esencia un soporte multidisciplinario. (shrink)

This study explores the rationality behind firms’ decision to admit or deny their involvement in bribery when responding to confidential surveys conducted by international agencies. Specifically, we posit that firms’ reluctance to provide accurate information about their engagement in bribery is at least to some extent contingent on certain situational factors. In other words, we claim that this behavior is context dependent. The paper uses the notions provided by the theory of planned behavior to understand the way in which the (...) corruption of the legal environment, the intensity of market competition, and identification risk influence firms’ decision to lie about their involvement in bribery. To test these notions, we use databases from the fifth wave of the EBRD-World Bank Business Environment and Enterprise Performance Survey, country-level data from the Kauffman Foundation and macroeconomic information from the World Bank database. We run ordinary least squares with geographic region-clustered standard errors on data from 30 countries and 6122 individual firms during the period 2012–2013. Consistent with our expectations, the results indicate that firms operating within more corrupt legal environments, facing more competition, and bearing a higher risk of being identified are less likely to deny their involvement in bribery. We conclude that not all firms have the same incentives to lie about their participation in bribery, and therefore, identifying the drivers of this heterogeneity may help policymakers better assess the reliability of bribery information collected through confidential surveys. Este artículo examina la jurisprudencia constitucional relativa a la legitimación en la Jurisdicción de lo Contencioso-Administrativa, en general, y sobre la legitimación de las asociaciones, particularmente, haciendo hincapié en la importancia de esta cuestión para la protección de los derechos constitucionales y la protección de los intereses colectivos. El autor, recordando que la legitimación activa plazo es la capacidad de una parte para demostrar a la corte que existe una vinculación suficiente con el objeto procesal a fin de justificar su (...) participación en el caso (algo que perder, algo para ganar), las notas el papel del Tribunal Constitucional español en subrayar que la legitimación activa debe interpretarse en sentido amplio, en contraste con otra sentencia más restrictivas en la jurisprudencia administrativa. La interpretación amplia de la legitimidad está estrechamente vinculada no solo con los derechos de acceso a la justicia (especialmente intensa cuando se determina la imposibilidad de obtener una respuesta judicial inicial) y el derecho constitucional a la tutela judicial efectiva, sino también para controlar judicial efectiva y la acción firme de la Administración con arreglo a Derecho por los tribunales, lo que permite combatir las prácticas corruptas y los casos de abuso del poder público. En resumen, la interpretación amplia de legitimación es la mejor solución contra los conceptos anticuados que impiden el acceso a la justicia. (shrink)

In this article, we analyze the patterns of culture of honor within Spanish families. Each member of 271 Spanish four-member families completed a questionnaire containing scales for the culture of honor and for sociodemographic variables. The results show that intra-family similarities emerge. However, path analyses show that the gender and birth order of the child are relevant in predicting this similarity. In particular, the first-born child converges with their mother to a higher extent than the father regardless of their gender. (...) However, for the second-born child both parents instill their ideas about culture of honor in a gender congruent way. Furthermore, there are higher similarities within younger families, indicating a stronger influence from parents to children. Assessing physical fitness has emerged as a proxy of the health status of children and adolescents and therefore as relevant from a public health point of view. DAFIS is a project included in Plan Galicia Saudable of the regional government of Galicia. DAFIS consists of an on-line software devoted to record the results of a standard physical fitness protocol carried out as a part of the physical education curriculum. The aims of this study were: to obtain normative values of physical (...) fitness of the Galician school population evaluated in the DAFIS project, and to identify a reduced number of components and tests able to capture a significant amount of the variability in the physical fitness of children and adolescents. From an initial sample of 27784 records, 15287 cases were considered after filtering. Generalized Additive Models for Location, Scale and Shape were used for obtaining percentile curves and tables for each sex. Furthermore, a principal components analysis was performed, selecting the number of components by applying the Kaiser’s rule and selecting a subset of variables considering the correlation between each variable and the components. Percentile curves and normative values are reported for each test and sex. Physical fitness was better in boys than in girls throughout age groups, except for flexibility that was consistently higher in girls. Two main components were detected throughout age groups: the first one representing body composition and partially cardiorespiratory fitness and the second one muscular fitness. For boys and girls, waist to height ratio had the highest correlations with the first component in four out of six age groups. The highest correlation with the second component, was most frequently observed for the handgrip test both in boys and girls. This study provides evidence about the utility of school community actions like DAFIS aimed to track the health-related fitness of children and adolescents. The results suggest that fat mass distribution and muscular performance concentrate a high proportion physical fitness variance. (shrink)

Television commercials are often thought of as bothersome multimedia artefacts that by their very existence spoil our viewing pleasure at regular intervals. Not only that, but they seem to have the habit of ordering us around. This aspect of TV ads has often been commented on by experts and laypersons alike. Therefore, we decided to tackle this issue and look at the prototypical expression of directives, that is, imperatives in voice-overs in television commercials. To this end we have carried out (...) an empirical analysis of imperatives in voice-overs in the MATVA corpus which contains transcriptions of nearly 800 voice-overs in British TV ads recorded on six days during 2009, 2010 and 2011. We provide an exhaustive quantitative and qualitative profile of imperatives in contemporary TV advertising. This includes information on the distribution of imperatives, the most common verbs in imperative clauses, and their discourse function. We are also able to show conclusively that the directive force of imperatives in TV ads is more akin to advice or recommendation than commands, and explain from a discourse-pragmatic perspective why this is so. Gracias al lenguaje y la presencia del otro se puede establecer una serie de premisas plausibles que permiten explicar cómo se lleva a cabo la acción en el ser humano. La conocida obra Muʿǧam al-buldān (Diccionario de los países), terminada por el geógrafo y erudito Yāqūt al-Rūmī al-Ḥamawī (m. 626/1229) un año antes de su muerte, ofrece una valiosa información sobre los múltiples topónimos recogidos por este autor. Dicha información no se limita solo a los aspectos geográficos, sino también a los literarios y biográficos, y ha sido abordada en trabajos relacionados con al-Andalus. Mi propósito en el presente artículo es realizar una primera aproximación a la imagen que Yāqūt proyecta (...) del Mágreb a través de algunos ejemplos concretos, realizando un breve recorrido de las fuentes que empleó, entre las cuales destacó especialmente el geógrafo andalusí Abū ʿUbayd al-Bakrī (m. 487/1094), muy citado en toda la obra. Background No studies have been conducted in Mexico to ascertain what ethical problems doctors working at hospitals deal with. This article aims to describe the ethical conflicts most commonly identified by Mexican internists and the importance they attribute to each of these conflicts. Methods Voluntary survey to the members of the Internal Medicine Association of Mexico. Results Responses were submitted by 347 internists. Half of those face ethical conflicts almost always or frequently. The most commonplace and relevant conflicts are those (...) resulting from the clinical relationship (communication, confidentiality, informed consent, assessment of mental capacity, decisions involving incapacitated patients, and conflicts with family members), and secondly those problems related with the end of life (palliative care, withholding or withdrawing treatment, and “No CPR orders”). To resolve conflicts they seek support through protocols, Institutional Ethics Committees (IECs), and consultations with colleagues and, occasionally, with bioethics experts. Protocols and IECs are the tools most in demand among them. Conclusions 1) the most frequent and relevant conflicts are those caused by the clinical relationship, above all those due to doctor–patient communication, and secondly those due to problems which arise at the end of life; 2) though nearly all of them have doubts about how to resolve conflicts, the vast majority are satisfied with the way in which they do so; 3) to deal with conflicts, they seek support mainly in protocols, IECs, and consultation with colleagues; and 4) in order to resolve them better, what they most demand are protocols and IECs, but also bioethics consultants. En 1968 Raquel Carson comenzaba una revolución en el pensamiento, quizá una de las de mayor peso en la actualidad. En su libro "La primavera silenciosa" acusaba del deterioro ambiental al poder ilimitado del ser humano. La creencia surgida en la modernidad de que todo lo que el hombre decidía era en sí mismo lo mejor por haber sido fruto de una voluntad libérrima, daba primacía y legitimidad absoluta a su acción sobre la naturaleza. Surgieron con gran fuerza numerosos grupos (...) ecologistas que adoptaron un pensamiento que responde al nombre de "ecología profunda" o "Deep Ecology" descrito por primera vez por Arme Naess en un artículo publicado por la revista Inquiry y titulado "The Shallow and the Deep, Long Range Ecology Movement". Los principios que proponía este movimiento (Naess 1984) pueden ser resumidos en ocho grandes puntos: 1) la vida de los seres no humanos es un valor en sí: 2) la riqueza y la diversidad de estas formas de vida son también valores en sí; 3) los seres humanos no pueden intervenir de manera destructiva en la vida; 4) a este respecto, la intervención humana actual es eminentemente excesiva; 5) por consiguiente, las reglas de juego deben ser radicalmente modificadas; 6) esta modificación radical debe hacerse tanto a nivel de las estructuras económicas como de las estructuras ideológicas y culturales; 7) a nivel ideológico, el cambio principal consiste en apreciar más la calidad de la vida que el goce de los bienes materiales; 8) las personas que acepten estos principios tienen la obligación de contribuir, directa o indirectamente a la realización de los cambios fundamentales que aquellos implican. The Purpose in Life Test is a measure of purpose in life widely used in many cultures and countries; however, cross-cultural assessments are scarce. The present study aimed to evaluate the cross-cultural measurement invariance of the PIL in the general population of seven Latin American countries. A total of 4306 people participated, selected by non-probabilistic convenience sampling, where Uruguay has the highest mean age ; while Ecuador has the lowest mean age. Furthermore, in each country, there is a higher proportion (...) of women than men. Using Multi-Group Confirmatory Factor Analysis, the factorial structure does not show evidence of invariance among the included countries. However, based on the Multi-Group Factor Analysis Alignment, there is evidence that a three-dimensional structure of the PIL is the same in the participating countries. Results based on item response theory indicate that most PIL items can significantly differentiate responses according to the level of life purpose. In addition, people with low life purpose will tend to choose the lower response alternatives on the PIL; while people with higher life purpose will choose higher response alternatives. The findings indicate that the PIL has the potential to increase knowledge about how people conceive and experience their purpose in life in different countries. (shrink)

Se establece un diálogo hermenéutico entre las concurrencias y bifurcaciones del idealismo simbólico de Cassirer y el racionalismo alado de Bachelard en tres momentos. Primero, a partir de indicios bio-bibliográficos se construye el contexto de significación vital donde se anclan sus respectivas ideas; segundo, se establecen entre ellos paralelismos fundamentales, y, tercero, se ofrecen ejemplos de la terminología bachelardiana, cercana a la hermenéutica simbólica contemporánea. Con ello se expande la comprensión de los análisis de Cassirer acerca del pensamiento indirecto e (...) interpretativo hacia las relaciones del hombre y la cultura, así como al papel del símbolo en el tránsito de la naturaleza a la cultura. The article establishes a hermeneutical dialogue between the convergences and divergences of Cassirer's symbolic idealism and Bachelard's winged rationalism. First, on the basis of bio-bibliographical evidence, it reconstructs the context of vital signification in which the authors' respective ideas are rooted; secondly, it identifies the fundamental parallelisms between them; and, finally, it provides examples of Bachelardian terminology that resembles that of contemporary symbolic hermeneutics. This results in a broader understanding Cassirer's analyses of indirect and interpretive thought regarding the relations between man and culture, as well as of the role of the symbol in the shift form nature to culture. Automatic public malware analysis services provide controlled, isolated and virtual environments to analyse malicious software samples. Unfortunately, malware is currently incorporating techniques to recognize execution onto a virtual or sandbox environment; when an analysis environment is detected, malware behaves as a benign application or even shows no activity. In this work, we present an empirical study and characterization of automatic PMAS, considering 26 different services. We also show a set of features that allow to easily fingerprint these services as analysis (...) environments; the lower the unlikeability of these features, the easier for us to fingerprint the analysis service they belong to. Finally, we propose a method for these analysis services to counter or at least mitigate our proposal. (shrink)

Hotel websites display textual and non-textual strategies with the aim of turning online visitors into customers. This article focuses on two related textual aspects: how consumers are discursively construed and how conditional constructions are used in order to persuade and convince consumers of the adequacy of the hotel. The framework adopted for the analysis combines Stern’s notion of ‘implied consumer’ with a corpus-driven approach. The corpus data comprises 114 British hotel websites and totals half a million words. This is a (...) subcorpus of COMETVAL, a database compiled at the University of València. The results reveal the importance of a number of words that address consumers directly or indirectly. These words intertwine with others to form patterns that help establish a bond between hoteliers and their clients. Further exploration of the corpus confirmed that some conditional sequences such as if you and should you are used by advertisers to speculate about the needs and wishes of consumers that the hotel can fulfil for them. The analysis suggests that conditional structures are a distinctive discursive characteristic strongly associated with the dialogic nature of the discourse hotel websites. (shrink)

This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. Resumen. El siguiente artículo muestra el estado actual de la Responsabilidad Empresarial enMéxico y su efecto en el Riesgo medido a través del Costo de Capital. Para ello, revisamos lasprincipales teorías que muestran que el uso de prácticas sociales en Estados Unidos provocandisminución del riesgo y por ende del Costo de Capital, Aras y Crowther, Richardson yWelker y Diamond y Verrechia. Con el fin de contrastar que las empresas SocialmenteResponsables tienen costos de capital menores consideramos como variable de desempeño social (...) eldistintivo que otorga el Centro Mexicano de Filantropía y por otra parte para calcular elriesgo consideramos el costo de capital a través de la metodología del Capital Asset Price Modelo. Encontramos que las empresas que son socialmente responsables tienen costos de capitalsuperiores que las que no son responsables y que el rendimiento de acciones es superior en lasempresas no responsables, por lo que el diferencial de riesgo vs rendimiento es superior en lasempresas no socialmente responsables. The following article shows the current status of the corporate responsibility inMexico and their effect on risk measured by the cost of capital. To do this, we review the maintheories that show that social practices in the United States leads to decrease risk and hence the costof Capital Aras and Crowther, Richardson and Welker and Diamond y Verrechia. In order to contrast that socially responsible companies have lower capital costs we considersocial performance variable the distinction conferred by the Mexican Center for Philanthropy and the cost of capital it estimate on the methodology of the Capital Asset Price model. We find that companies that are socially responsible have capital costs higher than thosethat are not responsible.
